In accordance with the “Contract Law of the People’s Republic of China” and relevant laws and regulations, combined with the characteristics of the construction of home decoration projects, both parties agree on the contract of the owner’s home decoration project (hereinafter referred to as Project) related matters, reached the following agreement:
Article 1 Project Overview
1.1 Project location: cms__cms__cms______.
1.2 Project content and methods (see Attachment 1: Construction Project Confirmation Form for Family Room Decoration and Renovation Project. Attachment 2: List of Family Room Decoration and Decoration Project Contents and Practices).
1.3 Project contracting method: The two parties agree to adopt the following ___ type of contracting method.
(1) The contractor contracts labor and materials (see Attachment 5 for details: List of Decoration Materials Provided by the Contractor);
(2) The contractor contracts labor, part of the materials, and the developer provides some materials (see Attachment 4: List of Decoration Materials Provided by the Employer for details. Attachment 5: List of Decoration Materials Provided by the Contractor);
(3) The contractor contracts the labor, and the client contracts the materials (see Attachment 4: List of Decoration Materials Provided by the Client for details).
1.4 The duration of the project is ____ days, the start date is ______________, and the completion date is ______________.
1.5 Contract price: The project cost of this contract is (capitalized): cms__cms____ yuan (see Attachment 3: Quotation List for Family Room Decoration Project for details).
Article 2 Project Supervision
If project supervision is implemented for this project, the developer and the supervision company shall sign a separate “Project Supervision Contract”, and notify the contractor of the name, unit, contact information and responsibilities of the supervision engineer.
Article 3 Construction drawings
The two parties agree that the construction drawings shall be provided in the following ___ way:
(1) The client designs and provides construction drawings by itself, and the drawings are in duplicate, one for the client and one for the contractor (see Attachment 6: Design Drawings for Family Room Decoration Engineering);
(2) The developer entrusts the contractor to design the construction drawings, the drawings are in duplicate, the developer and the contractor each have one copy (see Attachment 6: Design Drawings for Family Room Decoration Project), design fee (in capital letters) cms___ yuan, Paid by the developer (this fee is not included in the project price).
Article 4 Obligations of the Employer
4.1 ____ days before the start of construction, create conditions for the contractor to enter the construction site. Including: remove the indoor furniture, display or put the indoor furniture that is not easy to move, put the display into piles, and cover it, so as not to affect the construction as a principle;
4.2 Provide water source and power supply during construction;
4.3 Responsible for coordinating the relationship between the construction team and the neighbors;
4.4 Do not dismantle the indoor load-bearing structure. If you need to dismantle the non-load-bearing structure or equipment pipeline of the original building, you are responsible for going through the corresponding approval procedures with the relevant departments;
4.5 During the construction period, if the client still needs to partially use the living room, he shall be responsible for the security and fire protection of the construction site;
4.6 Participate in the supervision of project quality and construction progress, and be responsible for the entry of materials and completion acceptance.
Article 5 Contractor’s Obligations
5.1 Strictly implement safe construction operation specifications, fire protection regulations, construction specifications and quality standards during construction, and complete the project on schedule with guaranteed quality;
5.2 Strictly implement the regulations on construction site management, and do not disturb the residents and pollute the environment;
5.3 Protect the furniture and furnishings in the original living room, and ensure the smooth flow of the upper and lower water pipes in the living room;
5.4 Ensure the cleanliness of the construction site, responsible for cleaning the construction site after the completion of the project.
Article 6 Engineering change
If the project and construction method need to be changed, both parties should reach a consensus through consultation, sign a written change agreement, and adjust the relevant project cost and construction period at the same time (see Attachment 7: Family Room Decoration Project Change Form).
Article 7 Provision of Materials
7.1 For the materials and equipment provided by the developer (see Attachment 4: List of decoration materials provided by the developer), the developer shall notify the contractor before the materials are delivered to the construction site, and both parties shall jointly check and accept and handle the handover procedures;
7.2 For the materials and equipment provided by the contractor (see Attachment 5: Details of decoration materials provided by the contractor), the contractor should notify the developer before the materials are delivered to the construction site, and accept the developer’s inspection.
Article 8 Delay in construction period
8.1 If the completion date is delayed due to the following reasons, the construction period shall be postponed accordingly upon confirmation by the developer:
(1) Quantity changes and design changes;
(2) force majeure;
(3) Other circumstances where the developer agrees to extend the construction period.
8.2 If the construction period is affected because the developer fails to complete the work it should be responsible for, the construction period will be postponed; if the quality of the project is affected due to the unqualified materials and equipment provided by the developer, the rework costs will be borne by the developer, and the construction period will be postponed.
8.3 If the developer fails to pay the project payment on schedule, the contract period will be extended accordingly.
8.4 If the construction period is affected due to the failure of the contractor to start work on schedule or to stop work without reason, the construction period will not be extended; if there is a problem with the quality of the project due to the contractor’s reasons, the rework costs will be borne by the contractor, and the construction period will not be extended.
Article 9 Quality Standards
The two parties agree on the construction quality standard of this project: cms__cms__cms__cms__cms__cms__cms__cms_____.
During the construction process, the two parties have disputes over the quality of the project, and the cms______ department will certify the quality of the project. The quality of the certified project does not meet the standards stipulated in the contract, and the relevant expenses incurred during the certification process shall be borne by the contractor; Standards, related costs of the certification process shall be borne by the client.
Article 10 Project Acceptance and Warranty
10.1 The two parties agreed to check and accept the project quality in the following stages during the construction process:

(3)cms__cms__cms__cms__cms__.
The contractor should notify the developer two days in advance to check and accept, and fill out the project acceptance form after passing the stage acceptance (see Attachment 8: Family Room Decoration Project Acceptance Form).
10.2 After the completion of the project, the contractor should notify the developer to check and accept, and the developer should organize the acceptance within two days after receiving the acceptance notice, and fill in the project acceptance form (see Attachment 8: Family Room Decoration Project Acceptance Form). After clearing, go through the handover procedures (see Attachment 9: Family Room Decoration Project Settlement Statement for details).
10.3 The warranty period of this project is ____ months from the date of signing by both parties who pass the inspection and acceptance. After the acceptance is passed and signed, fill in the project warranty form (see Attachment 10: Family Room Decoration Project Warranty Sheet).
Article 11 Payment method of project payment
11.1 The two parties agree to pay the project fee in the following ____ way:
(1) After the contract becomes effective, the developer shall directly pay the project payment to the contractor as stipulated in the table below:

11.2 After the acceptance of the project, the contractor should submit the project settlement to the developer, and send the relevant materials to the developer. If the developer has no objection within ____ days after receiving the materials, it is deemed to have agreed, and both parties should fill in the project settlement (See Attachment 9: Settlement Statement for Family Room Decoration Project) and sign it, and the developer shall settle the final payment of the project with the contractor when signing.
11.3 After the project payment is fully settled, the contractor shall issue a formal unified invoice to the developer.
Article 12 Liability for breach of contract
12.1 If any of the parties to the contract is fined or causes losses to the other party due to failure to perform the contract or violation of national laws, regulations and relevant policies, the responsible party shall bear the responsibility and compensate the economic losses caused to the other party.
12.2 Without going through the acceptance procedures, the developer shall be responsible for the loss caused by the use of the finished project in advance or without authorization.
12.3 When the contract cannot continue to be performed due to one party’s reasons, the party shall promptly notify the other party, handle the contract termination procedures, and the responsible party shall compensate the other party for corresponding economic losses.
12.4 If the developer fails to pay the second (third) project payment on time, it shall pay the other party a liquidated damages of ____ yuan for each day of delay.
12.5 Due to the contractor’s reasons, if the quality of the project fails to meet the quality standards agreed by both parties, the contractor is responsible for repairs, and the construction period will not be extended.
12.6 If the construction period is delayed due to the contractor, a penalty of ____ yuan shall be paid to the other party for each day of delay.
Article 13 Resolution of Contract Disputes
Disputes that arise during the performance of this contract shall be resolved through negotiation between the parties; mediation may also be conducted by relevant departments; if negotiation or mediation fails, the following methods shall be used to resolve:
(1) Submit to cms_____ Arbitration Commission for arbitration;
(2) File a lawsuit in a people’s court according to law.
Article 14 Several Specific Provisions
14.1 The contractor is responsible for transporting the garbage generated due to project construction out of the construction site and to the designated place, and the contractor is responsible for paying the garbage removal fee (in capital letters) cms_____ yuan (this fee is not included in the project price) .
14.2 During the construction period, the developer will hand over ____ keys to the outhouse to the contractor for safekeeping. After the completion and acceptance of the project, the developer is responsible for providing ____ new locks, which will be installed and delivered by the contractor on the spot.
14.3 During the construction period, the contractor’s daily working hours are: ___ o’clock___ to ___ o’clock in the morning; ___ o’clock___ to ___ o’clock in the afternoon.

Article 16 Supplementary Provisions
16.1 This contract will come into effect after being signed (sealed) by both parties, and will be terminated after the contract is fulfilled.

16.4 The contract annex is an integral part of this contract and has the same legal effect as this contract.
